Terms of Service

These Terms of Service ("Terms") govern your access to and use of the diagnostic assistance service ("Service") operated by ConsoleRepair.ai ("we", "us", "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

1.1. The Service provides AI-assisted diagnostic information for Xbox console repair. It uses artificial intelligence to generate repair guidance, diagnostic suggestions, and technical information based on your queries.

1.2. The Service is intended for use by qualified electronics repair technicians and hobbyists with appropriate technical knowledge and equipment.

1.3. The Service is not affiliated with, endorsed by, or sponsored by Microsoft Corporation or any of its subsidiaries. "Xbox" is a registered trademark of Microsoft Corporation. All other trademarks are the property of their respective owners.

1.4. The diagnostic information provided by the Service is generated by AI based on factual technical information.

2. Accounts and Registration

2.1. To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials.

2.2. You must be at least 18 years old to create an account and use the Service.

2.3. You are responsible for all activity that occurs under your account.

2.4. We reserve the right to suspend or terminate any account at our sole discretion, with or without notice, for any reason including but not limited to breach of these Terms.

3. Credits and Payment

3.1. The Service operates on a prepaid credit system. You purchase diagnostic assistance credits ("Credits") which are consumed when you use the Service.

3.2. Credits are purchased in advance through our payment processor, Stripe. All prices are displayed in GBP.

3.3. Credits are non-transferable. Credits may not be sold, traded, or transferred to any other person or account.

3.4. Credits expire 30 days after the date of purchase. Expired Credits are forfeited and are not eligible for a refund. The expiry date of each Credit pack is displayed in your account. If your account is terminated for breach of these Terms, any remaining Credits are forfeited immediately regardless of their expiry date.

3.5. We reserve the right to change Credit pricing at any time. Price changes do not affect Credits already purchased.

3.6. If we permanently discontinue the Service, we will refund any unused Credits at the original purchase price within 30 days of the discontinuation date. We will notify you by email at least 30 days before any permanent discontinuation.

4. Refunds

4.1. Your refund rights are set out in our separate Refund Policy, which forms part of these Terms.

5. Acceptable Use

5.1. You agree to use the Service only for its intended purpose: obtaining AI-assisted diagnostic guidance for electronics repair.

5.2. You must not:

(a) systematically extract, scrape, harvest, or download data from the Service, whether by automated means (including bots, crawlers, or scripts) or through repeated manual queries designed to reconstruct or compile datasets — including capturing, recording, or copying the Service's responses through screenshots, screen recording, or manual transcription for the purpose of compiling technical data;

(b) reproduce, redistribute, publish, or make available any data obtained from the Service, whether in its original form or as a compiled dataset, including but not limited to diagnostic data, technical specifications, circuit data, measurement values, or component information;

(c) use the Service to build or contribute to any competing product, service, or dataset, or use data obtained from the Service to train, fine-tune, or evaluate any machine learning model or AI system;

(d) create multiple accounts, or share your account credentials with any other person, or allow multiple persons to use a single account — creating additional accounts to circumvent per-account usage limits or access controls is a breach of these Terms;

(e) attempt to circumvent any technical restrictions, rate limits, access controls, or security measures of the Service;

(f) reverse engineer, decompile, or disassemble the Service or any software used to provide it, or access the Service's APIs or data streams programmatically outside of the provided user interface;

(g) use the Service for any unlawful purpose;

(h) interfere with or disrupt the Service or the servers or networks connected to it.

5.3. Usage that exceeds reasonable diagnostic use — including but not limited to querying an excessive number of unique components, nets, or test points within a short period — may be treated as systematic extraction under Section 5.2(a), regardless of whether such queries are made individually or through automated means.

5.4. We may monitor usage patterns to detect violations of this section. Breach of the acceptable use provisions may result in immediate account termination without refund of unused Credits.

6. AI-Generated Content — Accuracy Disclaimer

6.1. The diagnostic information provided by the Service is generated by artificial intelligence and may contain errors, inaccuracies, or omissions. AI systems can produce incorrect or misleading output ("hallucinations"), including but not limited to:

(a) incorrect voltage values, resistance measurements, or other electrical specifications;

(b) misidentified components, pins, or test points;

(c) diagnostic procedures that are inapplicable to your specific board revision, fault condition, or component variant;

(d) contradictory or internally inconsistent guidance.

6.2. You must independently verify all diagnostic information before acting on it. Do not rely solely on the Service's output when making repair decisions that could cause damage to equipment, components, or personal injury.

6.3. The Service provides general diagnostic suggestions. It does not examine your specific device and cannot account for physical damage, prior modifications, component substitutions, counterfeit parts, or other conditions unique to the device in front of you.

7. Hardware Damage and Safety

7.1. Electronics repair carries inherent risks including but not limited to electric shock, burns, fire, damage to equipment, and personal injury. You acknowledge these risks and accept full responsibility for your safety and the safety of any equipment you work on.

7.2. We accept no liability whatsoever for any damage to hardware, components, tools, or other equipment arising from your use of or reliance on information provided by the Service.

7.3. We accept no liability for personal injury arising from your use of or reliance on information provided by the Service.

7.4. You should always follow appropriate safety procedures, use proper equipment, and work within the limits of your training and experience.

8. Manufacturer Warranty

8.1. Following repair advice from this Service may void your device manufacturer's warranty. If your device is under warranty, we strongly recommend contacting the manufacturer for authorised repair before using this Service.

8.2. We are not responsible for any loss of warranty coverage resulting from your use of the Service.

9. Intellectual Property

9.1. The Service, including its software, AI models, diagnostic methodology, user interface, and documentation, is the property of ConsoleRepair.ai or its licensors and is protected by copyright and other intellectual property laws.

9.2. These Terms do not grant you any rights in the Service other than a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purpose in accordance with these Terms.

9.3. You retain ownership of the content you submit to the Service (such as your chat messages and uploaded images). By submitting content, you grant us a licence to process that content as necessary to provide the Service.

10. Limitation of Liability

10.1. To the maximum extent permitted by law:

(a) the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and accuracy;

(b) we do not warrant that the Service will be uninterrupted, error-free, or free of harmful components;

(c) we do not warrant the accuracy, reliability, or completeness of any diagnostic information provided by the Service.

10.2. To the maximum extent permitted by law, our total aggregate liability to you for all claims arising out of or in connection with these Terms or your use of the Service shall not exceed the total amount of Credits you have purchased in the twelve (12) months immediately preceding the event giving rise to the claim.

10.3. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or equipment, whether based in contract, tort (including negligence), strict liability, or any other legal theory.

10.4. Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under English law.

11. Indemnification

11.1. You agree to indemnify and hold harmless ConsoleRepair.ai, its directors, officers, and employees from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

(a) your use of or reliance on the Service;

(b) any damage to hardware or equipment resulting from your use of the Service;

(c) your breach of these Terms;

(d) your violation of any applicable law or regulation.

12. Data Protection

12.1. We process your personal data in accordance with our Privacy Policy, which forms part of these Terms.

12.2. By using the Service, you acknowledge that your chat messages are processed by third-party AI providers (currently OpenAI) in order to generate diagnostic responses. Please refer to our Privacy Policy for details of international data transfers.

13. Modifications to Service and Terms

13.1. We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice, subject to Section 3.6 (refund of unused Credits on permanent discontinuation). We do not guarantee uninterrupted access to the Service. Temporary service unavailability does not entitle you to a refund of unused Credits. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

13.2. We may update these Terms from time to time. The updated Terms will be posted on the Service with a new "Last updated" date. Your continued use of the Service after the updated Terms are posted constitutes your acceptance of the updated Terms.

13.3. For material changes to these Terms, we will make reasonable efforts to notify you via email or through the Service.

14. Termination

14.1. You may stop using the Service and close your account at any time by contacting us.

14.2. We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

14.3. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination shall survive, including but not limited to sections 6, 7, 8, 10, 11, and 15.

15. Governing Law and Jurisdiction

15.1. These Terms are governed by and construed in accordance with the laws of England and Wales.

15.2. Any dispute arising out of or in connection with these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15.3. If you are a consumer, you may also have rights under the laws of the country in which you are resident, and nothing in these Terms affects those rights.

16. General

16.1. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16.2. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

16.3. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Service.

16.4. These Terms do not create any agency, partnership, joint venture, or employment relationship between you and us.
